சிறுபான்மை கல்வி நிறுவனங்களில் ஆசிரியர் நியமனங்களில் அரசு ஒழுங்குமுறைபடுத்தலாம்... உச்ச நீதிமன்றம் உத்தரவு
அரசு உதவிபெறும் சிறுபான்மை கல்வி நிறுவனங்களில் ஆசிரியர் நியமனம், மாணவர் சேர்க்கையை அரசு ஒழுங்குமுறைப்படுத்தலாம் என உச்சநீதிமன்றம் உத்தரவிட்டுள்ளது.
மேற்கு வங்கத்தில் மதரசாக்களில் ஆசிரியர் நியமனம் மற்றும் மாணவர் சேர்க்கையை ஒழுங்குமுறைப்படுத்த ஆணையம் அமைக்கப்பட்டது.
இதற்கு எதிராக தொடரப்பட்ட வழக்கில் மதரசா சர்வீஸ் கமிஷன் சட்டம் 2008- அரசியலமைப்புக்கு புறம்பானது என கொல்கத்தா உயர்நீதிமன்றம் தீர்ப்பளித்தது.
இதனை எதிர்த்து உச்சநீதிமன்றத்தில் தொடரப்பட்ட வழக்கில் நீதிபதிகள் அருண்மிஸ்ரா, யு.யு.லலித் அமர்வு தீர்ப்பளித்தது.
அதில் மேற்கு வங்க அரசின் மதரசா சர்வீஸ் கமிஷன் சட்டம் செல்லத்தக்கதே என தீர்ப்பளிக்கப்பட்டது.
கல்வி நிறுவனங்களில் திறமைக்கு முக்கியத்துவம் அளிக்க வேண்டும் என்பதில் நாடு முழுவதும் ஒருமித்த கருத்தே நிலவுகிறது. இதற்கு மதரசா போன்ற சிறுபான்மை கல்வி நிறுவனங்கள் நிச்சயம் விதிவிலக்கு இல்லை என்று நீதிபதிகள் தெரிவித்தனர்.
சிறுபான்மை கல்வி நிறுவனங்களுக்கு அரசியலமைப்பு வழங்கும் உரிமை வரம்பற்றது அல்ல எனவும் அவர்கள் கூறினர்.
சிறுபான்மை, பெரும்பான்மை என எந்த கல்வி நிறுவனங்களாக இருந்தாலும் அவற்றிற்கு அரசியல் சாசனத்தின் 30-வது பிரிவு பொருந்தும் என்றும் நீதிபதிகள் தங்கள் தீர்ப்பில் குறிப்பிட்டனர்.
இந்த தீர்ப்பின் மூலம் சிறுபான்மை கல்வி நிறுவனங்களின் நிர்வாகத்தை அரசு ஒழுங்குமுறைப்படுத்த வழிவகை ஏற்பட்டுள்ளது.
எதிர்வரும் காலத்தில் மாணவர் சேர்க்கை மற்றும் ஆசிரியர் நியமனம் தொடர்பான விவகாரங்களில் உச்சநீதிமன்றத்தின் இந்த தீர்ப்பை சுட்டிக்காட்டி தீர்ப்புகளை பெற முடியும் என்பது குறிப்பிடத்தக்கது.

The Commission was set up to regulate teacher appointment and student enrollment in Madrasas in West Bengal. The Madrasah Services Commission Act 2008 - The Supreme Court of Kolkata ruled that the Madras Services Commission Act was unconstitutional.
The Madras Services Commission of the West Bengal Government ruled that it was valid. There is a consensus across the country on the importance of talent in educational institutions. The judges said that minority education institutions such as the Madrasa were certainly not exempt from the constitution.
The judges also stated that Article 30 of the Constitution applies to any educational institution, whether minority or majority. The ruling paves the way for the government to regulate the administration of minority educational institutions.
It is noteworthy that the Supreme Court will be able to obtain judgments on this matter in relation to student admissions and teacher appointments in the foreseeable future.
